A small click is better than a big crashThe safety belt is recognized as the best protective measure for people in cars.  It reduces the risks of being killed or seriously injured by half during a collision and the Highway Safety Code obliges all occupants to wear a safety belt, specifically those reserved for the seat that they occupy.

Children measuring less than 63cm in seated position (from the seat to the top of the head) must be installed in a car seat appropriate for their weight and size.

As it is the driver who must make sure that any passengers less than 16 years of age buckle up, it is also they who will get the $80 to $100 fine plus three demerit points if they are stopped with no safety belts!

As of 16 years, any person neglecting to buckle their belt assumes the penalties imposed by the Law.

To act against the following rules constitutes a violation.

Fine and demerit points

Driver of a road vehicle not wearing the seat's allotted safety belt correctly

Passenger of a road vehicle not wearing the seat's allotted safety belt correctly

To drive a road vehicle with a passenger less than 16 years of age who does not wear the safety belt correctly

To drive a road vehicle with a child measuring less than 63 cm in a seated position who is not restrained by a car seat or booster chair.

Driver of a vehicle built after 1973 with more passengers than places provided with safety belts installed by the manufacturer

Exemptions 

  • Driver backing up.
  • Has a doctor's certificate from the SAAQ*.
  • Taxi drivers everywhere in the City of Montréal, except provincial jurisdiction roads.

* To profit from the exemption, the holder must carry their certificate and hand it to the officer upon request.

To be ignorant of these rules could cost you much more than the amount of the fine... It could cost you your life!
